Terms of Service

Budgetmend is a product and service of Kaai Tech LLC, a Delaware limited liability company ("Kaai Tech LLC", "we", "us", or "our").

These Terms of Service ("Terms") govern your access to and use of Budgetmend, including https://www.budgetmend.comand related applications (the "Service"). By creating an account or using the Service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.

If you do not agree, do not use the Service.

You must be at least 18 years old and capable of forming a binding contract to use Budgetmend. You are responsible for maintaining the confidentiality of your account credentials.

Budgetmend provides budgeting tools including paycheck planning, category budgets, transaction tracking, bill management, debt planning, savings goals, educational content, and optional personalized suggestions. The Service is for personal financial organization and education only — not professional financial, tax, investment, or legal advice.

Kaai Tech LLC is not a bank, broker-dealer, investment adviser, credit counselor, or fiduciary. We do not guarantee any particular financial outcome, savings amount, or accuracy of calculations.

You are solely responsible for financial decisions you make. Calculations, safe-to-spend estimates, affordability checks, and suggestions depend on data you enter, assumptions in the software, and timing of updates — they may not reflect your full financial picture or future changes.

Paid plans on https://www.budgetmend.com are billed through Stripe unless you purchased through an approved Digistore24 partner offer at https://www.budgetmend.com/partner-offer. Digistore24 purchases follow the payment, cancellation, and refund terms displayed during Digistore24 checkout. See our Refund Policy for details.

• Free trial: New accounts may receive a 14-day trial. You will be charged when the trial ends unless you cancel before then.
• In-app billing: You may manage your subscription, payment method, and invoices through your Budgetmend billing page.
• Cancellation: You may cancel at any time. Access continues through the end of the current billing period unless otherwise stated.
• Refunds: Except where required by law, fees are non-refundable once a billing period has started.

You agree not to:

• Use the Service for unlawful purposes
• Attempt to gain unauthorized access to systems or other accounts
• Interfere with or disrupt the Service
• Reverse engineer or scrape the Service except as permitted by law
• Share account access in ways that violate your plan terms
• Upload malicious code or abusive content

You retain ownership of budget data you enter. You grant us a license to host, process, and display that data solely to provide the Service, including automated suggestion features you use. See our Privacy Policy for details.

Budgetmend, its branding, software, and content (excluding your data) are owned by Kaai Tech LLC or its licensors. You may not copy, modify, or distribute our materials without permission.

Third-party names, logos, and trademarks mentioned on the Service (including in comparison content) belong to their respective owners. References do not imply endorsement.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE OR UNINTERRUPTED.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KAAI TECH LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100).

Some jurisdictions do not allow certain limitations; in those cases our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Kaai Tech LLC, its members, managers, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any law or third-party right; or (d) content or data you submit through the Service.

Informal resolution: Before filing a claim, you agree to contact us at support@budgetmend.com and allow at least 30 days to try to resolve the dispute informally.

Binding arbitration: Except for disputes that qualify for small claims court or injunctive relief for intellectual property or unauthorized access, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration shall be Delaware. The arbitrator may award relief only to the extent permitted by these Terms and applicable law.

Class action waiver: You and Kaai Tech LLC agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

We are not liable for delays or failures caused by events beyond our reasonable control, including natural disasters, war, labor disputes, internet or utility outages, third-party service failures (including bank data providers), or government actions.

You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, corporate reorganization, or sale of assets.

You may delete your account at any time. We may suspend or terminate access if you violate these Terms or if required for security or legal reasons. Sections that by nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law — will survive.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles, except where consumer protection laws in your jurisdiction provide otherwise.

We may modify these Terms. Continued use after changes become effective constitutes acceptance. Material changes will be communicated via email or in-app notice when practicable.
